LATERAL MOVEMENT OF DEFENCE FORCES PERSONNEL

1. The 6th CPC have (newly introduced concept) recommended that all future recruitment's to the posts of Short Service Commission and Personnel Below Officer Ranks in the Defence Forces, Central Police Organisations and Defence Civilian Organisations shall be common to all posts and conducted by Recruitment Boards of Defence Forces. The selected candidate shall initially serve in the Defence Forces for a minimum period of 7 years(extend able up to 17 years on certain conditions) before being laterally inducted into the analogous posts in the Central Para Military Forces, Central Police Organisations and various Defence Civilian Organisations. The seniority and pay etc will be protected for all, but the MSP in r/o Defence Forces personnel will be withdrawn, on their lateral movement/absorption. They will be governed by the Defence Forces pension benefits.

2. The Ministry of Home Affairs have initially opposed this Scheme, on the pleas that the Age Profile of CPOs will be Hit, the Training of Defence Personnel (TO KILL) is different from that of CPOs(TO CONTROL & NOT TO KILL), the Employment Opportunities will be Curtailed, The Career Progression of Existing Employees will be Affected, AND, It would be Difficult to Maintain ONE TO ONE PARITY between Different Posts in Defence Forces, Central Police Organisations and Defence Civilian Organisations. The 6th CPC had analysed and reviewed these objections and found the scheme viable with favourable administrative and financial aspects, and concluded, that the scheme is extremely viable, beneficial and no real drawbacks exists in effective implementation.

3. The 6th CPC further opined that implementation of this scheme will not only result is substantial financial savings for the Govt, but will also guarantee a lifetime employment to the Defence Forces Personnel. Besides, the Govt will have an abundant supply of trained manpower for induction into various posts in Central Police Organisations and Defence Civilian Organisations. And, THEREFORE, SHOULD BE IMPLEMENTED IN ITS ENTIRETY WITHOUT ANY DELAY.

4. The Ministry of Defence, GOI in their Resolution dated 30.8.08, have accepted the 6th CPC recommendations on this subject with a remark that "the matter will be examined separately". It is almost a full year elapsed and the action to be initiated on the issue is AWAITED. This issue is of UTMOST IMPORTANCE TO THE ARMED FORCES PERSONNEL, particularly the PBORs, who retire very early in their mid-30s, and search for alternate civil employment.


5. Perhaps, the policy of the GOI will, with all excitement, be put into operation on the occasion of the 140th Jayanthi celebrations of MAHATMA GANDHI, the Father of the Nation on 2.10.2009? That would be a befitting TRIBUTE to the MAHATMA and the Defence Forces Personnel. JAI HIND.

ASSURED CAREER PROGRESSION SCHEME FOR ARMED FORCES PERSONNEL (PBORs)

1. The 6th CPC (Para 2.3.34) have recommended that a Time Bound Promotion Scheme (Assured Career Progression Scheme) in the case of PBORs, allowing 2 financial upgradations on completion of 10 and 20 yrs of service (while the Govt agreed for 3 upgradations on completion of 08,16/24 yrs). This will allow a benefit of one increment and a higher Grade Pay. As regards the other sugggestion relating to the MOD may set up a Inter Services Committee to consider the matter after the revised scheme of revising pay bands is implemented.

2. The VI CPC recommendations in r/o the CG Civilian Employees were already implemented (orders issued), the same in r/o the AF personnel are yet to be issued, although nearly a full year had elapsed.

3. Your honour is requested to personally intervene and order issuance of Orders on ACP for AF personnel, URGENTLY.

DISPENSATION OF LINKAGE OF FULL PENSION WITH 33 YEARS QUALIFYING SERVICE (VI CPC) OF DEFENCE FORCES PBORs - W.E.F. 1.1.2006

1. You are aware that the GOI approved the VI CPC recommendations(Para 5.1.33), on dispensation of Linkage of Full Pension with 33 years of Qualifying Service to earn pension in r/0 the CG civilian employees w.e.f. 1.11.2006 and the GOI( Dept of P&PW), Min of PPG&P issued orders(No.7/7/2008(P&PW(F) d/d 13.2.09). (The linkage of full pension with 33 years of qualifying service should be dispensed with. Once the employee renders minimum service of 20 years, pension should be paid at 50% of the average emoulments received during the last 10 months or the pay last drawn, whichever is more beneficial to the employee. Simultaneously, the extant of benefit of adding years of qualifying service for the purpose of computing pension related benefits should be withdrawn as it would no longer be relevant. - Accepted vide Govt Res.No.38/37/2008-P&PW(A) d/d 29.8.08)

2. Further, payment of full pension on completion of 20 years qualifying service will take effect only prospectively for all Central Govt servantsother than PBORs of Defence Forces, from the date it is accepted by the Govt.

3. Sir, the PBORs are eligible for pension on completion of 15 years of minimum reckonable service, but it is 20 years minimum for CG Employees. The above order authorises full pension at 50% of average pay of last 10 months or last pay drawn, whichever beneficial to the CG employee. The Pre-96 PBORs of Defence Forces are a disadvantaged lot as their full pensions are fixed/calculated on 50% pay on 33 years pro-rata reduction for less number of years of reckonable service. This is a total catastrophe to the PBORs and discrimination and also against equity aand natural justice.

4. You are requested to personally intervene and order for extending the above full pension entitlement of CG employees (on 20 yrs compl.50% average emoulments/last pay drawn whichever is beneficial) to the Defence Forces PBORs also, (on completion of 15 years of reckonable service) keeping in view their conditions of service. This would go a longway in improving the existing pension anamolies of PBORs to a great extent.

5. It is brought to your kind notice that although nearly a full year had elapsed but thee relevant orders for AF personnel (PBORs) are yet to be issued.

6. You are requested to personally intervene and order issuance of above GO in r/o PBORs URGENTLY.

REVISION OF RATION ALLOWANCES FOR ARMED FOECES PERSONNEL

1. The rate of Ration Allowances for the AF Personnel were revised to Rs.36.91ps from 1.4.08 to 31.3.09, and as per the 6th CPC recommendations, these were made applicable to all CPMFs w.e.f. 1.9.08. The Railway board had issued orders to this effect available here Order of Revised Rates of Ration Allowances
2. The 6 th CPC (Para 2.1.1.) while fixing the minimum wages of the CG employees w.e.f. 1.1.2006, had adopted and calculated the monthly rates of rations etc. (as per 15 ILC Norms), as given below:-


- Rice / Wheat - Rs.769.50ps
- Dal(Toor/Urad) - Rs.288.00ps
- Raw Vegetables - Rs. 90.00ps
- Gr.leaf Vegetables -Rs.112.50ps
- Other vegetables - Rs.67.50ps
- Fruits - Rs.324.00ps
- Milk (200ml/18 Lt) - Rs. 432.00ps
- Sugar/Jaggery - Rs.120.00ps
- Edible oil - Rs. 180.00ps
Eggs (90 Nos) - Rs.180.00ps
Total - Rs.2563.50ps and
- Fish - Rs. 300.00ps
-Meat -Rs. 600.00ps
Gr.total Rs.3463.50ps./per month, Or @ Rs.115.50ps p.d

As can be seen from the above, Rs.115.50ps per day figure arrived at the 6th CPC is apparently for a single person expenditure per day, as on or before 1.1.2006. But there is no provision made for fluctuating prices. On comparison of prices of present times, the above rates donot buy them for even 10 days.

Furthermore Sir, have a glance @Rs.36.91ps per day, the rate of rations of AF personnel and it is beyond imagination as to how these rates arrived at in the first place, and their revisions at regular intervals. The subject matter apparently does not matter the AF officers and the unmarried PBORs since they get rations in lieu.

It is requested that the issue my be personally looked into and order the concerned authorities to devise the Ration Allowance for the AF personnel rationally, and revise the same periodically (quarterly at least) keeping in view the market prices, URGENTLY.

IMMEDIATE ISSUANCE OF ORDERS ON PIP/IMPROVEMENT OF PENSIONARY BEBEFITS TO ALL PRE-06 PBORs

1. It may be recalled again that the pensions of Pre-96 PBORs were devised fully on the basis of CG pensioners w.e.f. 1.1.96 (Min of Per, Pub Grie.GOI order of 27.10.97. i.e.the revised pension shall not be less than @ 50% of Min scale in the scale of pay – Rs.1275/- (V CPC) from Rs 375/-(IV CPC).

2. But the Min scale in the scale of pay of a AC (Gp I,II,III,IV&V) of IAF as on 1.1.96 was Rs.3675/-, Rs.3200/-, Rs.3050/- and Rs.2975/- and therefore the min pension must have been Rs.1838/-, Rs.1600/-, Rs.1515/-, Rs.1498/- respectively in terms of Para of GOI MOD orders of 7.6.99. But taking refuse in Para 2.2.(a), the MOD themselves declared that these orders will not be beneficial to lower rank PBORs and did not implement revision of pensions of Pre-96 PBORs pensions w.e.f.1.1.96.

3. The MOD restructured the Trades w.e.f. 10.10.97 based on the entry level Qualifications and (merged some) in X, Y and Z Groups in place of I -X,II&III-Y, and IV&V-Z, and as a result some scales of pay also got changed. But this order too was not applied to Pre-97 PBORs. .If, applied, the Min pension of AC (Gp X,Y,Z) of IAF w.e.f. 10.10.97 muust have been Rs. 1838/-, Rs.1625/-, Rs.1525/- respectively. But this was not done by the MOD.

4. Based on the recommendations of GoM on improvement of Pensionary benefits to Pre-96 PBORs, the MOD issued another order wherein the Min pension was raised by 1.5 times of Rs.1275/- to Rs.1913/- w.e.f. 1.1.96. The said MOD order also enhanced the weightage of years from 5 years to 10,8 and 6 years respectively to the 3 lower ranks. Here again the PCDA(P) Allahabad vide their Circular No.350, had still fixed the Min Pen of the 3 lower ranks PBORs at Rs.1275/- and or less than the stipulated enhancement of 1.5 times increase of old penion of Rs.1275/- to Rs.1913/-. (Tables – 59, 60, 61, 62, 69,70, 72, 74,75,76,77). Upon implementation of these orders of MOD, the minimum pensions of ACs (Gp X,Y and Z) must have been Rs. 2757/-, Rs.2438/- and Rs.2388/- respectively.

5. The GOI had announced payment of Dearness Pay @ 50% of DA (to be merged with the basic pay) to all CG employees w.e.f. 1.4.04. This was also made applicable to PBORs and was paid. But the DP was paid at lesser rates (on old Basic pension rates ) from 1.4.04 and not on the (to be) revised rates stated at para 4 above. i.e. w.e.f. 10.10.97 revised 50% of DP for AC (Gp X,Y &Z) @ Rs.1379/-, Rs.1219/- and Rs.1194/- respectively w.e.f. 1.4.04 and upto 31.12.05.

6. The GOI MOD had revised the PBORs pensions w.e.f. 1.1.06 (6 CPC), subject to a minimum of Rs.3500/- (50% of lowest pay+grade pay applicable to CG retirees. The VI CPC further reduced the groups to X& Y and introduced an element of X pay of Rs.1400/- for X group and merging the Z group into Y. The multiplication factor has been 2.26 times on the existing pension. The PCDA(P) Allahabad again defined the existing pensions as per Circular 350 only. Hence the PBORs pensions have been fixed at old rates only as applicable to CG employees and MSP element was also not taken into account. And going by the improved Basic pensions (para 4 above) of ACs (Gp X ) would have been Rs.2757 x 2.26 =Rs.6230.82ps and (Gp Y) Rs.5510/- By adding 50% element of MSP to these Basic pension, the final pension figures of Pre-06 PBORs should have been – for Xgp AC = Rs. 7230/- and Y Gp AC = Rs.6510/-.

7. Now the GOI MOD had announced that pensions of all the Pre-97 PBORs be brought on par with Post 97 PBORs. This takes care of all the above anamolies, by simple modification of relevant para in 7.6.99 order.

8. In this connection, the following uncomfortable questions arise:-

(a) Why the Pensions of PBORs were not fixed as per the stipulated
modified GOI MOD order d/d 7.6.99 that NOT LESS THAN 50% PAY IN
the Scale of Pay w.e.f. 1.1.96?

(b) Why was the MOD order of 7.6.99 was issued when it was known
that the Pre-96 PBORs were not benefited by such orders?.

© Why was the MOD Orders of 10.11.00 (restructured Trades/groups ) were
not applied to Pre-96 PBORs pensions?

(d) Again why the GOI MOD Orders of 1.2.06 were not implemented with
Minimum pension clause of Rs.1913/- (1.5 time increase over the earlier
Min Pension of Rs.1275/-?

(d) Why should the large number of PBORs be denied their pension monies
besides causing misery/hardship, for over a long over 12 year period
to them due to careless or otherwise implementation of Govt Orders.

9. In fitness of things and to meet the ends of justice, the Pension Arrears may pleasebe paid to the PBORs on the above lines, and with a 10% simple interest thereon till the date of payment, at the earliest, for which the entire PBOR community would be grateful to the GOI MOD.

COMMITTEE OF SECRETARIES HEADED BY CABINET SECRETARY : GIST OF RECOMMENDATIONS

1. In turning down OROP the Committee has relied on earlier committee and GOM reports, SC judgement on ESL petition filed as a sequel to the decision in DS Nakara & Ors Vs Union of India, and advice of the Ministry of Law.

The Committee also interacted with various ESM Associations, namely, the IESL and the Air Force Association to seek their views. The Associations gave the following major options in regard to OROP:
Option 1 Calculation of the pension of pre-1.1.2006 retirees by reckoning the highest of the pay in the pay band for each rank and thereafter application of weightage to this figure.
Option 2 Calculation of the pension of pre-1.1.2006 retirees by taking the mid-point between the minimum fitment of each rank in the revised pay band and maximum of the pay band and thereafter applying the weightage.
Option 3 Calculation of the pension of pre- 1.1.2006 retirees with reference to the notional maximum in the post- 1.1.2006 pay scales. Thereafter the weightage may be applied.
Options 1&2 were found not feasible as even the pension of post 1.1.2006 retirees is not calculated on this basis. “However, the option 3 is similar to the benefit granted in 2006 based on the recommendations of the GOM.”

Summary of Recommendations
PBOR
(1)Bring pre-10.10.1997 PBOR pensioners on par with post 10.10.1997 PBOR pensioners. (financial implication – 470.66 Crore per annum)
(2)Accept enhancement of classification allowance wef 1.1.2006 on notional basis (as in case MSP). This would benefit around 88000 PBOR. (Financial implication – 7.73 Crore per annum). To be implemented wef 1.1.2006 and pay arrears.
(3) Notional, weightage sans Arrears:
(a) Reckon pension of all pre 1.1.2006 PBOR pensioners with reference to a notional maximum in the post 1.1.2006 revised pay structure corresponding to the maximum of pre-Sixth Pay Commission pay scales as per fitment table of each rank.
(b) Also to continue with the enhanced weightage awarded by the GOM.
This will result in average monthly increase in the pension of pre 1.1.2006 PBOR in the range of Rs 800 to Rs 1400 for Gp Y depending on rank and years of service. Will benefit 12 lakh pre 1.1.2006 PBOR pensioners, (financial implication – 1636 Crore per annum). Being a new concession applies prospectively. No arrears.
Commissioned Officers
(4) Remove linkage of full pension with 33 years of qualifying service wef 1.1.2006 instead of 1.9.2008. Will benefit around 1100 officers (Army) whose pension would increase by about Rs 3000 pm (financial implication – 4.83 Crore per annum). Proposal emanates from Sixth PC; implement from 1.1.2006 and pay arrears.
(5) A separate pay scale starting at 67000 and going up to 79000 be created and all offrs at the level of Lt Gen/Addl Secy/equivalent be fixed in this scale. As a result, pension of pre-1.1.2006 Lt Gens will get fixed at 36500.00 and those of Addl Secys at 33500.00. Will benefit roughly 4000 offrs. (Financial implication – 25 Crore per annum). Proposal emanates from Sixth PC; implement from 1.1.2006 and pay arrears. The Committee has justified the increase for Lt Gens by stating that after the Sixth PC recommendations, the pensions of pre-1.1.2006 Brigs, Colonels and Lt Cols have greatly improved and in percentage terms there is very little difference the pension of pre-1.1.2006 and that with ref to minimum of fitment tables. The difference is around 2% at the level of Lt Col, 6% at the level of Colonel, 11% at the level of Brigadier, 13% at the level of Maj Gen. Only at the level of Lt Gen is there a difference of about 26%.
