PURCHASE OF CAR BY PBORs : DISPLAY OF CSD LETTER

PURCHAS OF CAR BY PBOR

GENERAL

2. Consequent to improved socio-economic conditions and purchasing power, the COSC has accorded permission to serving and retired PBORs to purchase four wheelers through the CSD with effect from 01 Jan, 2009 based on certain operative conditions to ensure that the facility is not misused, procedures and safeguards given in the succeeding paragraphs will be strictly adhered to.

ELIGIBILITY AND CONDITIONS FOR PURCHASE

3. Eligibility – All PBOR (serving and retired of the three services having minimum of 15 years colour service and having been released honorably are entitled to purchase a four wheelers up to 1300 CC capacity.

4. PROCEDURE AND Contitions:-

(a) JCOs/ equivalent can purchase the second car after five years of the initial purchase and all other entitled Soldiers / Sailors / Airmen after seven years. Sale of car is not allowed before completion of two years from the date of purchase.

(b) Serving and retired PBORs will apply on the prescribed forms as enclosed at Appendices 'A' and 'B' respectively (which will be provided by the concerned CSDd Depot)

(c) Following documents shall be submitted along with the application;-

an affidavit of Rs. 5/- on Non Judicial Stamp Paper

(Appendix 'D') covering the following:-

(aa) I have not purchased a car in the last 5/7 years as applicable.

(bb) I shall not sell the car for the next two years.

(ac) I understand that any violation of the above will

make me liable to pay back the entire excise/ sales

tax concessions to the Govt.

(ad) The vehicle is for my personal use.

(ae) The vehicle purchased form the CSD will be

registered on self name.

(d) Entry with regards to purchase of car by retd PBOR will be made on the original PPO at the Depot.

5. MISUSE – In case an individual is found to have violated any of the above conditions, that is, purchase of second car before five / seven years or sale of car before two years form the date of purchase, he will be liable to pay the full excise duty / sales tax as applicable.

ACTION BY THE CSD

6. At the CSD depot level, following actions will be taken on receipt of

application from the PBOR:-

(a) Verify the correctness of the details furnished by the PBOR.

(b) Cross check from CSD HO whether the Concerned PBOR has already purchased a car from any other CSD Depot in the last 5/7 years.

(c) Share the date with regards to purchase of car by PBOR with other depots.

(d) The PBOR will be allowed to purchase the car only after receipt of confirmation form CSD HO.

(e) In case of retired PBO following additional actions shall be taken :-

(i) Ensure the affidavits as per Appendix 'D' has been received.

(ii) Ensure entry of purchase of car with date is made on the original PPO.

7. CSD HO will be responsible for collecting the information of all purchase at All India level. A consolidated quarterly report of all purchases will be forwarded by CSD Head Office to the DDGCS.

8. This office letter No. 96410/Q/DDGCS dated 08 Aug, 06 and 12 Oct, 07 are hereby cancelled.

COMPASSION/COMMITMENT OF INDIAN ARMY : SPENDS RS.2150 CR ANNUALLY FOR DEVELOPMENT OF J&K STATE

           """""Besides fighting insurgency in the state and securing the border, the Army is contributing to its economic development as well. The Army is also boosting human resource development in the state, as it has employed a large number of youths.

             Every year, 800 to 1,000 soldiers are recruited in the Army from the state,” said Brig G. Murali of the Udhampur-based Northern Command. The Army has raised six Home and Hearth (H and H) battalions absorbing more than 6,582 youths from the state. The H and H employment is given to locals and members of families affected by militancy,” he said. The Army employs more than 15,000 porters and around 17,000 ponies.

             Besides providing employment to locals, the Army also adds to the economic growth of the state by procuring items of daily consumption at the local level. " Everyday, the Army procures 33,000 litres of milk that is around 25 per cent of the total daily requirement of the Army in the state,” said Brig Murali. The Army also makes other local purchases that costs more than Rs 800 crore to the state’s exchequer annually.

           “The Army pays Rs 800 crore annually to the state government in the form of electricity and other rental payments,” Brig Murali said.

            The Army has also undertaken various other developmental projects in the state. In period 2008-09, the Army constructed 14 bridges, while construction work on 22 bridges was being executed.

           “The Army runs 51 goodwill schools in the state, where 11,353 students study. It runs two residential schools also in the state. It sponsors 240 students to six residential schools in the country,” Brig Murali said.   He added, “The Army also provides help to the state government schools in their renovation, construction of additional class rooms and other such facilities for the students.”

2.         Now, please look at the FUNDS DEPLOYED for the above @ per annum on a rough conservative estimate (and not exact) is about Rs.2150 crores:-  

-- Rectt of 800/1000 soldiers into the army : Salary and Perks @ 2 lakh pa per person = 2000 lakhs/20 cr.

-- H and H Batt.6572 persons : Salary and Perks @2 lakh pa per person = 13144lakhs/131.44 cr

-- Porters 15000 and Ponies 17000= 32000 : Expenses @1 lakh pa per each = 32000lakh/320 cr

-- Milk proced for army- 33000 ltrs @Rs.25/- Ltr. : Rs.8.25 lakh p.d x365days = 30.12

-- Other local purchases by army in state  Rs.800 cr pa = 800 cr

-- Rent and Elect charges payments to state  Rs.800 cr pa = 800 cr

-- 14 bridges constructed in state   Appx. Estimate  =10 cr

-- 22 bridges under construction in state : Appx. Estimate  =25 cr

-- Runs 51 schools(11353 students)in state : Appx.Estimate  =5 cr

-- Runs 10 hostels (620 capacity) in state :  Appx.Estimate 20  lakhs pm =2.4 cr

-- Runs 26 Women Centres(738 capacity) in state : Appx  Estimate 50 lakh pm    = 6 cr

3.      INCIDENTALLY, the Hon. Finance Minister's announcement in the Union Budget on Fund Estimated  for "ONE RANK ONE PENSION'" FOR ARMED FORCES PERSONNEL is Rs.2144.22 cr.

DELAY IN SETTING UP OF NATIONAL COMMISSION FOR EX-SERVICEMEN BY GOI (MOD)

1. It is a full year since the Govt of India announced that they are actively considering to set up a NATIONAL COMMISSION FOR EX-SERVICEMEN, exclusively to cater to the needs of ex-servicemen, martyrs and families and their welfare issues. Perhaps, implementation of the VI CPC recommendations, conduct of General Elections- 2009, Constitution of Armed Forces Tribunal (and appointment of Judges/Members) have delayed the process. Now, it is time that the Govt. urgently constitute the same so that the Ex-servicemen pending issues get resolved faster. The briefings of Hon.Defence Minister and The Secretary, ESW on the subject are appended below for the information of all :-

"(A) THE HON. DEFENCE MINISTER, SHRI A.K. ANTONY, on Friday(29.8.08) said that the government would soon set up an Ex-Servicemen Commission to address the grievances of armed forces veterans and plan welfare schemes for them. After opening a new department in the Defence Ministry for ex-servicemen, the government is going to set up an Ex-Servicemen Commission soon to recommend various welfare schemes for them and their families, Antony said, during the inauguration function of a Sainik School at Thappa Gothra Khori village near Rewari in Haryana.
He also said that the government had earmarked around Rs 6,000 Crore additionally for serving defence personnel and ex-servicemen after removing the anomalies in the recommendations of the sixth pay commission, which was being implemented from 1st September. Antony urged other States of the country to learn from Haryana, he further added that he is very impressed with Haryana government efforts in taking care of its ex-servicemen and providing them welfare schemes.
The Sainik Schools are today one of the major vehicles to carry forward the movement of mass discipline in our society, he said. (Source :Thaindian News-29.8.08)


(B) THE SECRETARY E S W :- A proposal to constitute a National Commission for the Welfare of Ex-Servicemen is under the active consideration of the government. This was stated by the Secretary (Ex-Servicemen Welfare) in the Ministry of Defence, Deepa Jain Singh in her inaugural address to the annual conclave of the Directorate General of Resettlement (DGR) here today (30.7.08). The measure will expedite issues of rehabilitation, welfare and help resolve grievances of retired soldiers, martyrs and their families, she said.
Nearly 60,000 personnel retire from the three wings of the armed forces every year and most of them are in the productive middle age group. There are nearly 14 lakh Ex-servicemen and over 2.5 lakh widows. When this figure is projected considering each Ex-Servicemen minor children, dependent parents, brothers and sisters, it could affect the livelihood of close to one crore population, she added. In view of the vast population of Ex-Servicemen, the government last year created the post of Secretary in the Defence Ministry to deal exclusively with issues related to the Ex-Servicemen welfare.
Deepa Singh, who has undertaken an exhaustive study on the welfare of Ex-Servicemen during her short four-month stint as Secretary (ESW), said a capsule on the subject is soon to be introduced at the Lal Bahadur Shastri Academy, Mussourie. It would sensitize the young IAS probationers of the vital issues of concern related to the Ex-Servicemen Welfare before they assume responsibility of the District Magistrate posts across the country. PURCHASE OF CAR FROM CSD CANTEEN : PBORS

IN THE END, A PERSON IS ONLY KNOWN
BY THE IMPACT HE OR SHE HAS ON OTHERS.

For All Dear PBORs friends. Please find below the information regarding purchase of car by PBORs from CSD Canteen. The Govt. of India, Ministry of Defence, vide their letter No. 96410/Q/DDGCS dt. 23 Oct. 2008 issued by Integrated HQ of MOD (Army) Army HQs / QMG's Branch, Dy. Dte. Gen. Canteen Services, has authorized serving and retired PBORs to purchase four wheelers through the CSD with effect from 01 Jan 2009 up to 1300 CC capacity.

This facility has been accorded to PBORs as a result of great struggle by various ESM organizations including Indian Ex-Services League, Punjab & Chandigarh, headed by the undersigned. However, we are utterly disappointed by the eligibility conditions imposed by Ministry of Defence on the purchase of car through CSD by PBORs. Following conditions are to be fulfilled by the PBORs before they can purchase car:-
1. PBOR should have retired honorably with pension after a colour service of 15 years.
2. The retired PBORs shall submit an affidavit of Rs. 5/-on Non Judicial Stamp Paper covering the following:-
(a) He has not purchased the car in the last 5 years (for JCO) and 7 years (for other rank).
(b) The vehicle is for his personal use.
(c) Vehicle will be registered on his name.
Entry with regards to purchase of car by retd PBOR will be made on the original PPO at the Depot.
After that CSD will take the following action:-
(a) Verity the correctness of the details furnished by the PBOR.
(b) Cross check from CSD HO whether the Concerned PBOR has already purchased a car from any other CSD Depot in the last 5 / 7 years.
(c) Share the data with regards to purchase of car by PBOR with other depots.

PBOR will be allowed to purchase the car only after receipt of confirmation from CSD Head Office.
No such condition is applicable to officer and all officers including ECs and SSCs, not drawing pension, are allowed to purchase a car of any capacity after a gap of 2 years.
This organization has already taken of the case of these additional conditions applicable to PBORs with Integrated HQ of MOD (Army) Adjutant General's Branch and they have further asked QMG Branch for the reasons for the additional conditions applicable to PBORs vide their letter no. B/33152/AG/PS-2(c) dt. 5 June 2009 with a copy to this league HQ.
So far no reply has been received from QMG Branch. Same will be displayed on this blog as and when received.

ENHANCEMENT OF FIXED MEDICAL ALLOWANCE TO ARMED FORCES PERSONNEL(PENSIONERS/FAMILY PENSIONERS)

1. The GOI, Ministry of Defence, on the Recommendations of the 5th CPC, have granted a fixed Medical Allowance of Rs.100/-pm to all Armed Forces Pensioners/Family Pensioners (including future pensioners/family pensioners)residing in areas that are not covered by the Central Govt. Health Scheme from the year 1997, to meet the day-to-day medical expenses that do not require hospitalisation.

2. In the present day context, this allowance of Rs.100/- is not sufficient to meet even the lowest rate of one time Consultation charges of a Doctor, leave alone buying the prescribed medicines by the pensioners. The inflation has caused sharp increase in prices in general and the prices of medicines in particular, which abnormally rose by 15-20 times of prices of 1997-98.

3. The vast majority of Armed Forces Pensioners, especially PBORs/family pensioners belong to and are settled in remote rural areas, that are not covered by CGHS facilities. They, being sick/infirm and of advanced age, are prone to frequent sickness/diseases. Other adverse conditions such as lack of support or indifference of family members, social security and lack of avocation or work etc. play their part. The luxury/facility of a Doctor or even a RMP is not available at their places and as such, they invariably have to visit/travel to nearby town for medical treatment, usually with an escort since they cannot make it on their own. This involves transportation cost of about Rs.30/-to 50/-per person (one way)on an average, which is inescapable to them.

4. Keeping in view to overcome the above, it becomes all the more necessary justification that the Fixed Medical Allowance of the Armed Forces Pensioners/family pensioners may be Enhanced to Rs.2000/-pm by the Govt of India, w.e.f. 1.9.08. and issue orders urgently.

LATERAL MOVEMENT OF DEFENCE FORCES PERSONNEL

1. The 6th CPC have (newly introduced concept) recommended that all future recruitment's to the posts of Short Service Commission and Personnel Below Officer Ranks in the Defence Forces, Central Police Organisations and Defence Civilian Organisations shall be common to all posts and conducted by Recruitment Boards of Defence Forces. The selected candidate shall initially serve in the Defence Forces for a minimum period of 7 years(extend able up to 17 years on certain conditions) before being laterally inducted into the analogous posts in the Central Para Military Forces, Central Police Organisations and various Defence Civilian Organisations. The seniority and pay etc will be protected for all, but the MSP in r/o Defence Forces personnel will be withdrawn, on their lateral movement/absorption. They will be governed by the Defence Forces pension benefits.

2. The Ministry of Home Affairs have initially opposed this Scheme, on the pleas that the Age Profile of CPOs will be Hit, the Training of Defence Personnel (TO KILL) is different from that of CPOs(TO CONTROL & NOT TO KILL), the Employment Opportunities will be Curtailed, The Career Progression of Existing Employees will be Affected, AND, It would be Difficult to Maintain ONE TO ONE PARITY between Different Posts in Defence Forces, Central Police Organisations and Defence Civilian Organisations. The 6th CPC had analysed and reviewed these objections and found the scheme viable with favourable administrative and financial aspects, and concluded, that the scheme is extremely viable, beneficial and no real drawbacks exists in effective implementation.

3. The 6th CPC further opined that implementation of this scheme will not only result is substantial financial savings for the Govt, but will also guarantee a lifetime employment to the Defence Forces Personnel. Besides, the Govt will have an abundant supply of trained manpower for induction into various posts in Central Police Organisations and Defence Civilian Organisations. And, THEREFORE, SHOULD BE IMPLEMENTED IN ITS ENTIRETY WITHOUT ANY DELAY.

4. The Ministry of Defence, GOI in their Resolution dated 30.8.08, have accepted the 6th CPC recommendations on this subject with a remark that "the matter will be examined separately". It is almost a full year elapsed and the action to be initiated on the issue is AWAITED. This issue is of UTMOST IMPORTANCE TO THE ARMED FORCES PERSONNEL, particularly the PBORs, who retire very early in their mid-30s, and search for alternate civil employment.


5. Perhaps, the policy of the GOI will, with all excitement, be put into operation on the occasion of the 140th Jayanthi celebrations of MAHATMA GANDHI, the Father of the Nation on 2.10.2009? That would be a befitting TRIBUTE to the MAHATMA and the Defence Forces Personnel. JAI HIND.

WINDS OF CHANGE : MILITARY OFFFICERS APPOINTED AS APPOINTING/DISCIP./APPELLATE AUTHY IN R/O CIVILIAN EMPLOYEES

1. The GOI have amended the CCS(CCA) Rules 1965 thro' a Gazette Notification dated 16.07.09. which can be accessed here The Military Officers are appointed as Appointing Authority, Disciplinary Authority and Appellate Authrities in respect of Civilian employees upto Group B level, in a select military establishments su h as IMA,NDA etc.

2. But why the other similar establishments like AFA, Naval Academy and other important training institutions are not included in this amendment is not known. May be that happens a little later.

A CASE FOR URGENT REFIXATION OF PAY (BANDS/GRADE PAY) AND ALLOWANCES/PENSIONS OF ARMED FORCES PERSONNEL - W.E.F. 01.01.2006

Respected Sir,

The following is submitted for your kind perusal, please.

1. The 6th CPC recommendations have added more woes to the already beleaguered Armed Forces Personnel in respect of Pay, Pay Grade, and Pension related decisions, particularly to the lower/middle level functionaries. The comparison of army Sepoy with a police Constable appear to be main reason for this fiasco. The job criteria/service/working conditions of a Sepoy( and equivalent in AF/Navy) are distinctively different from that of a Constable.

2. The process of recruitment of army personnel emphasizes requirement of able bodied and fairly educated/intelligent youngsters so as to train them to the combatant service which is fairly technological and highly skilled. They are required to render most of their services usually in extreme geographical/climatic conditions, treacherous/inhospitable terrains along the borders of the country, facing the enemy forces. The professional hazard here is simply THE PHYSICAL THREAT OR RISK TO LIFE and hence stands unparalleled and comparable to any other service under the government. Apart from this known element of SUPREME SACRIFICE conditionality, the AF Personnel are subject to (a) Frequent Postings in all directions on borders and far away from native place/district/state, (b) Unfamiliar/inhospitable/extreme climatic conditions in places of posting, (c) Unsuitable/forced circumstances in not allowing families to stay at workstations, resulting in extra expenditure on maintenance of more than one establishment, (d) Inability to take care of the family/social obligations and protect family/ancestral properties due to prolonged absence from home. No amount of monetary compensation can substitute these peculiarities, which are simply not known to the Civilian employees.

3. It may be pointed out that the Sepoy 's pay scale was always more than the Constable/LDC in the IV and V CPC revisions of pay. It is unfortunate that this time in VI CPC revision, the Sepoy's pay has been fixed at the lowest along with Group D employees scales for some unfair, unknown and inexplicable reasons (the Peons,NCs(E), Lascars, Mess Waiters/Water Carriers etc are now clubbed with LDC/UDC and Sepoys). Furthermore, all other ranks of PBORs and also the Commissioned officers have been fixed their pay scales/grade pay , unjustly, @ of at least ONE RANK BELOW w.e.f. 1.1.06. This requires urgent correction. Therefore, to set right this unjust anomaly, the following suggested course of re fixation/revision of pay scales/grade pays would meet the ends of justice:-

(A) PAY SCALE AND GRADE PAY IN PAY BANDS
(a) PBORs (EQUIVALENTS IN ARMY/NAVY):

AIRCRAFTMAN - PB-1 AND GRADE PAY Rs.2400/-

LEADING A/C - PB-1 AND GRADE PAY Rs.2800/-

CORPORAL - PB-1 AND GRADE PAY Rs. 3600/-

SERGEANT - PB-2 AND GRADE PAY Rs.4200/-

JUNIOR W.O. - PB-2 AND GRADE PAY Rs4600/-

WARRANT OFFICER - PB-2 AND GRADE PAY Rs4800/-

MASTER W.O. - PB-2 AND GRADE PAY Rs5400/-

(HONY FG OFFR - PB-3 AND GRADE PAY Rs.6100/-

AND HONY FLT LT -PB-3 AND GRADE PAY Rs.6600/-)

(b) COMMISSIONED OFFICERS( The commissioned Officers' ranks have been subjected to avoidable reduction in pay scales from 1.1.86 onwards (rank pay de-linked/deducted from basic pay) and the matter is sub-judice (Maj Dhanapalan's case):-

FLIGHT CADET (ON JOINING ACADEMY) - PB-3 AND GRADE PAY Rs.5400/-

FLYING OFFICER - PB-3 AND GRADE PAY Rs.6100/-

FLIGHT LIEUTENANT- PB-3 AND GRADE PAY Rs.6600/-

SQUADRON LEADER - PB-3 AND GRADE PAY Rs.7600/-

WING COMMANDER - PB-4 AND GRADE PAY Rs.8900/-

GROUP CAPTAIN - PB-4 AND GRADE PAY Rs.10000/-

( B) MILITARY SERVICES PAY :- The existing fixed rates of Rs.2000/-(PBORs) and Rs.6000/- (Officers) appear be not commensurate with rank or length of service. Equity and natural justice demand that this pay be allowed akin to other allowances like HRA, DA etc. on certain percentage basis. Accordingly the following fair rate(s)is suggested:-

(a) PBORs/JCOs - @50% of Basic pay of the rank held or 1.5 times of Grade pay applicable to their rank, subject to a minimum of Rs.2000/-.

(b) Officers - @ 33%of Basic Pay of the rank held or 1.25 times of Grade Pay applicable to their rank, subject to a minimum or Rs.6000/-

(c) NCs(E): The NCs(E) also don service uniform (although they are non-combatants) but their service conditions are similar to PBORs. It would be just and proper they too get MSP @Rs.1500/-flat rate.

(C) PENSIONS :- The pensions of the Officers and PBORs may be revised to the 70% of the total emoluments (last 10 months average) or the last pay drawn, whichever is beneficial to them for the 15/20 year respective eligibility of pensions,(de-linking 33 year condition for earning full pension) for all w.e.f. 1.1.06. This will ensure all senior ranked PBORs/Officers get more pension than their juniors (past or present).

(D) MEDICAL ALLOWANCES:- Presently the Medical allowance is paid at a fixed rate of Rs.100/-p.m. to all non-CGHS covered PBORs. This is very meagre and negligible especially in the context of soaring rates of medicines or the consultation charges of the Doctors. So, in fitness of things, this allowance may be increased to Rs.2000/-pm w.e.f. 1.9.08.

(E)LATERAL ABSORPTION/MOVEMENT:- The general perception that the personnel of Armed Forces are fit for Security or Guards duties is ill-conceived and illogical. The VI CPC, therefore, strongly recommended for Lateral Absorption/movement of AF personnel to CPOs/CPMFs and other other organisations of Defence Ministry. But the PBORs/officers of the Armed Forces are well-trained and richly experienced in their respective fields. Their USP is the ability to work superbly under severe stress/strain and often ON THE FACE OF DANGER TO LIFE. Their disciplined life/work style fits them to any type of job with ease and a little bit of guidance. Therefore, it is in fitness of things that a flat 10% posts in all categories of Central/State Govt Depts may be earmarked for this purpose and implemented immediately to utilise the rich experienced work force and avoid loss of time and resources in future recruitment/training of fresh work force to that extent.

But the GOI had approved setting up of a Medical College for CPMFs as a long term solution to recruit doctors to treat the troops (now 700 vacancies of doctors). The GOI soon to sanction one Heptarambulance (Helicopter Ambulance) to treat the troops.

The Diseases and numbers are confounding. Are the standard medical tests not done on the recruits before taking them into CRPF? Is there no medical treatment available to them in the units? Set up a Medical College now for CPMFs now in order to recruit MOs (700 posts)? Why and How? How many troop patients can be attended by this Heptarambulance? How are the troops going to get promotional avenues? How are the families going to stay with and support them? The Govt did not approve the OROP scheme to a dozen ex-servicemen with an outlay of 400-500 cr outlay on the non-feasible financial/administrative grounds? are some searching questions.

After enlightening ourselves with the meanings stated above, it can safely be surmised that neither the Pay Commission Cells of our Armed Forces (Army/Navy/Air Force) have properly projected the case of PBORs to the 6 th CPC thro' GOI MOD nor the 6th CPC themselves seem to have perceived the peculiarity /speciality of the Armed Forces in proper perspective in recommending the pay scales to AF Personnel (PBORs), resulting in the present fiasco.

A JOURNEY MAY BE SHORT OR LONG, BUT IT MUST START AT THE VERY SPOT ONE FINDS ONESELF.

SPECIALITY OF ARMED FORCES TRIBUNAL

1. The just inauguared Armed Forces Tribunal, will be on par with The High Court for Armed Forces Personnel cases. The Principal Bench (plus 2 Regional Benches) shall be located as New Delhi, 3 Regional Benches each in Chandigarh and Lucknow and 1 each in Jaipur, Mumbai, Kolkata, Guwahati, Chennai and Kochi.

2. It does not bind itself to the Civil Procedure Code and hence provides for flexibility in procedure as long as they are in conformity with the Principles of Natural Justice. It stress on predictability in hearing and adjournments in very exceptional cases, is a welcome sign in disposal of cases faster and in a time bound manner. ASSURED CAREER PROGRESSION SCHEME FOR ARMED FORCES PERSONNEL (PBORs)

1. The 6th CPC (Para 2.3.34) have recommended that a Time Bound Promotion Scheme (Assured Career Progression Scheme) in the case of PBORs, allowing 2 financial upgradations on completion of 10 and 20 yrs of service (while the Govt agreed for 3 upgradations on completion of 08,16/24 yrs). This will allow a benefit of one increment and a higher Grade Pay. As regards the other sugggestion relating to the MOD may set up a Inter Services Committee to consider the matter after the revised scheme of revising pay bands is implemented.

2. The VI CPC recommendations in r/o the CG Civilian Employees were already implemented (orders issued), the same in r/o the AF personnel are yet to be issued, although nearly a full year had elapsed.

3. Your honour is requested to personally intervene and order issuance of Orders on ACP for AF personnel, URGENTLY.

DISPENSATION OF LINKAGE OF FULL PENSION WITH 33 YEARS QUALIFYING SERVICE (VI CPC) OF DEFENCE FORCES PBORs - W.E.F. 1.1.2006

1. You are aware that the GOI approved the VI CPC recommendations(Para 5.1.33), on dispensation of Linkage of Full Pension with 33 years of Qualifying Service to earn pension in r/0 the CG civilian employees w.e.f. 1.11.2006 and the GOI( Dept of P&PW), Min of PPG&P issued orders(No.7/7/2008(P&PW(F) d/d 13.2.09). (The linkage of full pension with 33 years of qualifying service should be dispensed with. Once the employee renders minimum service of 20 years, pension should be paid at 50% of the average emoulments received during the last 10 months or the pay last drawn, whichever is more beneficial to the employee. Simultaneously, the extant of benefit of adding years of qualifying service for the purpose of computing pension related benefits should be withdrawn as it would no longer be relevant. - Accepted vide Govt Res.No.38/37/2008-P&PW(A) d/d 29.8.08)

2. Further, payment of full pension on completion of 20 years qualifying service will take effect only prospectively for all Central Govt servantsother than PBORs of Defence Forces, from the date it is accepted by the Govt.

3. Sir, the PBORs are eligible for pension on completion of 15 years of minimum reckonable service, but it is 20 years minimum for CG Employees. The above order authorises full pension at 50% of average pay of last 10 months or last pay drawn, whichever beneficial to the CG employee. The Pre-96 PBORs of Defence Forces are a disadvantaged lot as their full pensions are fixed/calculated on 50% pay on 33 years pro-rata reduction for less number of years of reckonable service. This is a total catastrophe to the PBORs and discrimination and also against equity aand natural justice.

4. You are requested to personally intervene and order for extending the above full pension entitlement of CG employees (on 20 yrs compl.50% average emoulments/last pay drawn whichever is beneficial) to the Defence Forces PBORs also, (on completion of 15 years of reckonable service) keeping in view their conditions of service. This would go a longway in improving the existing pension anamolies of PBORs to a great extent.

5. It is brought to your kind notice that although nearly a full year had elapsed but thee relevant orders for AF personnel (PBORs) are yet to be issued.

6. You are requested to personally intervene and order issuance of above GO in r/o PBORs URGENTLY.

REVISION OF RATION ALLOWANCES FOR ARMED FOECES PERSONNEL

1. The rate of Ration Allowances for the AF Personnel were revised to Rs.36.91ps from 1.4.08 to 31.3.09, and as per the 6th CPC recommendations, these were made applicable to all CPMFs w.e.f. 1.9.08. The Railway board had issued orders to this effect available here Order of Revised Rates of Ration Allowances
2. The 6 th CPC (Para 2.1.1.) while fixing the minimum wages of the CG employees w.e.f. 1.1.2006, had adopted and calculated the monthly rates of rations etc. (as per 15 ILC Norms), as given below:-


- Rice / Wheat - Rs.769.50ps
- Dal(Toor/Urad) - Rs.288.00ps
- Raw Vegetables - Rs. 90.00ps
- Gr.leaf Vegetables -Rs.112.50ps
- Other vegetables - Rs.67.50ps
- Fruits - Rs.324.00ps
- Milk (200ml/18 Lt) - Rs. 432.00ps
- Sugar/Jaggery - Rs.120.00ps
- Edible oil - Rs. 180.00ps
Eggs (90 Nos) - Rs.180.00ps
Total - Rs.2563.50ps and
- Fish - Rs. 300.00ps
-Meat -Rs. 600.00ps
Gr.total Rs.3463.50ps./per month, Or @ Rs.115.50ps p.d

As can be seen from the above, Rs.115.50ps per day figure arrived at the 6th CPC is apparently for a single person expenditure per day, as on or before 1.1.2006. But there is no provision made for fluctuating prices. On comparison of prices of present times, the above rates donot buy them for even 10 days.

Furthermore Sir, have a glance @Rs.36.91ps per day, the rate of rations of AF personnel and it is beyond imagination as to how these rates arrived at in the first place, and their revisions at regular intervals. The subject matter apparently does not matter the AF officers and the unmarried PBORs since they get rations in lieu.

It is requested that the issue my be personally looked into and order the concerned authorities to devise the Ration Allowance for the AF personnel rationally, and revise the same periodically (quarterly at least) keeping in view the market prices, URGENTLY.

A CASE FOR GRANT OF BONDED ALLOWANCE TO ARMED FORCES PERSONNEL

1. The Career in the Armed Forces, perhaps, ONE OF ITS KIND, is linked to Supreme Sacrifice during the course of its deployment in war or peace times. The extreme and exacting physical fitness of the prospective personnnel is the tough demand of the Armed Forces Training Institutes to keep them in physical/fighting fitness not only during the training but also throughout the career. Leave alone the deaths occuring at borders during wars of skirmishes with enemies or terrorists, the GOI, MOD specifically indemnifies themselves NOT LIABLE for any INJURIES/DEATH during the process of RECRUITMENT OR TRAINING at Military Training Institutes. 2. The GOI, on the recommendations of VI CPC had extended several benefits of the AF personnel on par basis , to the Civilian employees. But the GOI/6th CPC have conveniently ignored that the AF Personnel are subject to Army/AF/Navy Acts,(which are very Stringent) in addition to all other Laws of the Land. Thus, the DOUBLE RISKS of SUPREME SACRIFICE AND INACCECIBILITY to several rights available to their CG Employees to redress their grievances. The GOI is fully aware of AF Personnel's special working circumstances and, therefore, taken steps like Creation of a Separate Dept for Ex-SM afffairs in MOD, Formation of Armed Forces Tribunal to exclusively deal the legal cases, and agreeing to set up a Separate Pay Commission to them.

3. This Bond Remuneration to AF personnel may be granted at least @ Rates on par with that of @ 25% of basic pay granted to CG Employees working in NE Regions, w.e.f. 1.9.08, to be just and make good this deficiency, to AF Prsonnel.

IMMEDIATE ISSUANCE OF ORDERS ON PIP/IMPROVEMENT OF PENSIONARY BEBEFITS TO ALL PRE-06 PBORs

1. It may be recalled again that the pensions of Pre-96 PBORs were devised fully on the basis of CG pensioners w.e.f. 1.1.96 (Min of Per, Pub Grie.GOI order of 27.10.97. i.e.the revised pension shall not be less than @ 50% of Min scale in the scale of pay – Rs.1275/- (V CPC) from Rs 375/-(IV CPC).

2. But the Min scale in the scale of pay of a AC (Gp I,II,III,IV&V) of IAF as on 1.1.96 was Rs.3675/-, Rs.3200/-, Rs.3050/- and Rs.2975/- and therefore the min pension must have been Rs.1838/-, Rs.1600/-, Rs.1515/-, Rs.1498/- respectively in terms of Para of GOI MOD orders of 7.6.99. But taking refuse in Para 2.2.(a), the MOD themselves declared that these orders will not be beneficial to lower rank PBORs and did not implement revision of pensions of Pre-96 PBORs pensions w.e.f.1.1.96.

3. The MOD restructured the Trades w.e.f. 10.10.97 based on the entry level Qualifications and (merged some) in X, Y and Z Groups in place of I -X,II&III-Y, and IV&V-Z, and as a result some scales of pay also got changed. But this order too was not applied to Pre-97 PBORs. .If, applied, the Min pension of AC (Gp X,Y,Z) of IAF w.e.f. 10.10.97 muust have been Rs. 1838/-, Rs.1625/-, Rs.1525/- respectively. But this was not done by the MOD.

4. Based on the recommendations of GoM on improvement of Pensionary benefits to Pre-96 PBORs, the MOD issued another order wherein the Min pension was raised by 1.5 times of Rs.1275/- to Rs.1913/- w.e.f. 1.1.96. The said MOD order also enhanced the weightage of years from 5 years to 10,8 and 6 years respectively to the 3 lower ranks. Here again the PCDA(P) Allahabad vide their Circular No.350, had still fixed the Min Pen of the 3 lower ranks PBORs at Rs.1275/- and or less than the stipulated enhancement of 1.5 times increase of old penion of Rs.1275/- to Rs.1913/-. (Tables – 59, 60, 61, 62, 69,70, 72, 74,75,76,77). Upon implementation of these orders of MOD, the minimum pensions of ACs (Gp X,Y and Z) must have been Rs. 2757/-, Rs.2438/- and Rs.2388/- respectively.

5. The GOI had announced payment of Dearness Pay @ 50% of DA (to be merged with the basic pay) to all CG employees w.e.f. 1.4.04. This was also made applicable to PBORs and was paid. But the DP was paid at lesser rates (on old Basic pension rates ) from 1.4.04 and not on the (to be) revised rates stated at para 4 above. i.e. w.e.f. 10.10.97 revised 50% of DP for AC (Gp X,Y &Z) @ Rs.1379/-, Rs.1219/- and Rs.1194/- respectively w.e.f. 1.4.04 and upto 31.12.05.

6. The GOI MOD had revised the PBORs pensions w.e.f. 1.1.06 (6 CPC), subject to a minimum of Rs.3500/- (50% of lowest pay+grade pay applicable to CG retirees. The VI CPC further reduced the groups to X& Y and introduced an element of X pay of Rs.1400/- for X group and merging the Z group into Y. The multiplication factor has been 2.26 times on the existing pension. The PCDA(P) Allahabad again defined the existing pensions as per Circular 350 only. Hence the PBORs pensions have been fixed at old rates only as applicable to CG employees and MSP element was also not taken into account. And going by the improved Basic pensions (para 4 above) of ACs (Gp X ) would have been Rs.2757 x 2.26 =Rs.6230.82ps and (Gp Y) Rs.5510/- By adding 50% element of MSP to these Basic pension, the final pension figures of Pre-06 PBORs should have been – for Xgp AC = Rs. 7230/- and Y Gp AC = Rs.6510/-.

7. Now the GOI MOD had announced that pensions of all the Pre-97 PBORs be brought on par with Post 97 PBORs. This takes care of all the above anamolies, by simple modification of relevant para in 7.6.99 order.

8. In this connection, the following uncomfortable questions arise:-

(a) Why the Pensions of PBORs were not fixed as per the stipulated
modified GOI MOD order d/d 7.6.99 that NOT LESS THAN 50% PAY IN
the Scale of Pay w.e.f. 1.1.96?

(b) Why was the MOD order of 7.6.99 was issued when it was known

(d) Why should the large number of PBORs be denied their pension monies
besides causing misery/hardship, for over a long over 12 year period
to them due to careless or otherwise implementation of Govt Orders.

9. In fitness of things and to meet the ends of justice, the Pension Arrears may pleasebe paid to the PBORs on the above lines, and with a 10% simple interest thereon till the date of payment, at the earliest, for which the entire PBOR community would be grateful to the GOI MOD.

COMMITTEE OF SECRETARIES HEADED BY CABINET SECRETARY : GIST OF RECOMMENDATIONS

1. In turning down OROP the Committee has relied on earlier committee and GOM reports, SC judgement on ESL petition filed as a sequel to the decision in DS Nakara & Ors Vs Union of India, and advice of the Ministry of Law.

The Committee also interacted with various ESM Associations, namely, the IESL and the Air Force Association to seek their views. The Associations gave the following major options in regard to OROP:
Option 1 Calculation of the pension of pre-1.1.2006 retirees by reckoning the highest of the pay in the pay band for each rank and thereafter application of weightage to this figure.
Option 2 Calculation of the pension of pre-1.1.2006 retirees by taking the mid-point between the minimum fitment of each rank in the revised pay band and maximum of the pay band and thereafter applying the weightage.
Option 3 Calculation of the pension of pre- 1.1.2006 retirees with reference to the notional maximum in the post- 1.1.2006 pay scales. Thereafter the weightage may be applied.
Options 1&2 were found not feasible as even the pension of post 1.1.2006 retirees is not calculated on this basis. “However, the option 3 is similar to the benefit granted in 2006 based on the recommendations of the GOM.”

Summary of Recommendations
PBOR
(1)Bring pre-10.10.1997 PBOR pensioners on par with post 10.10.1997 PBOR pensioners. (financial implication – 470.66 Crore per annum)
(2)Accept enhancement of classification allowance wef 1.1.2006 on notional basis (as in case MSP). This would benefit around 88000 PBOR. (Financial implication – 7.73 Crore per annum). To be implemented wef 1.1.2006 and pay arrears.
(3) Notional, weightage sans Arrears:
(a) Reckon pension of all pre 1.1.2006 PBOR pensioners with reference to a notional maximum in the post 1.1.2006 revised pay structure corresponding to the maximum of pre-Sixth Pay Commission pay scales as per fitment table of each rank.
(b) Also to continue with the enhanced weightage awarded by the GOM.
This will result in average monthly increase in the pension of pre 1.1.2006 PBOR in the range of Rs 800 to Rs 1400 for Gp Y depending on rank and years of service. Will benefit 12 lakh pre 1.1.2006 PBOR pensioners, (financial implication – 1636 Crore per annum). Being a new concession applies prospectively. No arrears.
Commissioned Officers
(4) Remove linkage of full pension with 33 years of qualifying service wef 1.1.2006 instead of 1.9.2008. Will benefit around 1100 officers (Army) whose pension would increase by about Rs 3000 pm (financial implication – 4.83 Crore per annum). Proposal emanates from Sixth PC; implement from 1.1.2006 and pay arrears.
(5) A separate pay scale starting at 67000 and going up to 79000 be created and all offrs at the level of Lt Gen/Addl Secy/equivalent be fixed in this scale. As a result, pension of pre-1.1.2006 Lt Gens will get fixed at 36500.00 and those of Addl Secys at 33500.00. Will benefit roughly 4000 offrs. (Financial implication – 25 Crore per annum). Proposal emanates from Sixth PC; implement from 1.1.2006 and pay arrears. The Committee has justified the increase for Lt Gens by stating that after the Sixth PC recommendations, the pensions of pre-1.1.2006 Brigs, Colonels and Lt Cols have greatly improved and in percentage terms there is very little difference the pension of pre-1.1.2006 and that with ref to minimum of fitment tables. The difference is around 2% at the level of Lt Col, 6% at the level of Colonel, 11% at the level of Brigadier, 13% at the level of Maj Gen. Only at the level of Lt Gen is there a difference of about 26%.
