IMMEDIATE ISSUANCE OF ORDERS ON PIP/IMPROVEMENT OF PENSIONARY BEBEFITS TO ALL PRE-06 PBORs

1. It may be recalled again that the pensions of Pre-96 PBORs were devised fully on the basis of CG pensioners w.e.f. 1.1.96 (Min of Per, Pub Grie.GOI order of 27.10.97. i.e.the revised pension shall not be less than @ 50% of Min scale in the scale of pay – Rs.1275/- (V CPC) from Rs 375/-(IV CPC).

2. But the Min scale in the scale of pay of a AC (Gp I,II,III,IV&V) of IAF as on 1.1.96 was Rs.3675/-, Rs.3200/-, Rs.3050/- and Rs.2975/- and therefore the min pension must have been Rs.1838/-, Rs.1600/-, Rs.1515/-, Rs.1498/- respectively in terms of Para of GOI MOD orders of 7.6.99. But taking refuse in Para 2.2.(a), the MOD themselves declared that these orders will not be beneficial to lower rank PBORs and did not implement revision of pensions of Pre-96 PBORs pensions w.e.f.1.1.96.

The MOD restructured the Trades w.e.f. 10.10.97 based on the entry level Qualifications and (merged some) in X, Y and Z Groups in place of I -X,II&III-Y, and IV&V-Z, and as a result some scales of pay also got changed. But this order too was not applied to Pre-97 PBORs. .If, applied, the Min pension of AC (Gp X,Y,Z) of IAF w.e.f. 10.10.97 muust have been Rs. 1838/-, Rs.1625/-, Rs.1525/- respectively. But this was not done by the MOD.

4. Based on the recommendations of GoM on improvement of Pensionary benefits to Pre-96 PBORs, the MOD issued another order wherein the Min pension was raised by 1.5 times of Rs.1275/- to Rs.1913/- w.e.f. 1.1.96. The said MOD order also enhanced the weightage of years from 5 years to 10,8 and 6 years respectively to the 3 lower ranks. Here again the PCDA(P) Allahabad vide their Circular No.350, had still fixed the Min Pen of the 3 lower ranks PBORs at Rs.1275/- and or less than the stipulated enhancement of 1.5 times increase of old penion of Rs.1275/- to Rs.1913/-. (Tables – 59, 60, 61, 62, 69,70, 72, 74,75,76,77). Upon implementation of these orders of MOD, the minimum pensions of ACs (Gp X,Y and Z) must have been Rs. 2757/-, Rs.2438/- and Rs.2388/- respectively.

5. The GOI had announced payment of Dearness Pay @ 50% of DA (to be merged with the basic pay) to all CG employees w.e.f. 1.4.04. This was also made applicable to PBORs and was paid. But the DP was paid at lesser rates (on old Basic pension rates ) from 1.4.04 and not on the (to be) revised rates stated at para 4 above. i.e. w.e.f. 10.10.97 revised 50% of DP for AC (Gp X,Y &Z) @ Rs.1379/-, Rs.1219/- and Rs.1194/- respectively w.e.f. 1.4.04 and upto 31.12.05.

6. The GOI MOD had revised the PBORs pensions w.e.f. 1.1.06 (6 CPC), subject to a minimum of Rs.3500/- (50% of lowest pay+grade pay applicable to CG retirees. The VI CPC further reduced the groups to X& Y and introduced an element of X pay of Rs.1400/- for X group and merging the Z group into Y. The multiplication factor has been 2.26 times on the existing pension. The PCDA(P) Allahabad again defined the existing pensions as per Circular 350 only. Hence the PBORs pensions have been fixed at old rates only as applicable to CG employees and MSP element was also not taken into account. And going by the improved Basic pensions (para 4 above) of ACs (Gp X ) would have been Rs.2757 x 2.26 =Rs.6230.82ps and (Gp Y) Rs.5510/- By adding 50% element of MSP to these Basic pension, the final pension figures of Pre-06 PBORs should have been – for Xgp AC = Rs. 7230/- and Y Gp AC = Rs.6510/-.

7. Now the GOI MOD had announced that pensions of all the Pre-97 PBORs be brought on par with Post 97 PBORs. This takes care of all the above anamolies, by simple modification of relevant para in 7.6.99 order.

8. In this connection, the following uncomfortable questions arise:-

(a) Why the Pensions of PBORs were not fixed as per the stipulated
modified GOI MOD order d/d 7.6.99 that NOT LESS THAN 50% PAY IN
the Scale of Pay w.e.f. 1.1.96?

(b) Why was the MOD order of 7.6.99 was issued when it was known
that the Pre-96 PBORs were not benefited by such orders?.

© Why was the MOD Orders of 10.11.00 (restructured Trades/groups ) were
not applied to Pre-96 PBORs pensions?

(d) Again why the GOI MOD Orders of 1.2.06 were not implemented with
Minimum pension clause of Rs.1913/- (1.5 time increase over the earlier
Min Pension of Rs.1275/-?

(d) Why should the large number of PBORs be denied their pension monies
besides causing misery/hardship, for over a long over 12 year period
to them due to careless or otherwise implementation of Govt Orders.

9. In fitness of things and to meet the ends of justice, the Pension Arrears may pleasebe paid to the PBORs on the above lines, and with a 10% simple interest thereon till the date of payment, at the earliest, for which the entire PBOR community would be grateful to the GOI MOD.
